Defective ITR Notice under Section 139(9):
How to Correct Tax Audit, Balance Sheet and Form 26AS Mismatches

Receiving a Section 139(9) notice does not mean tax evasion has occurred. It indicates an internal inconsistency or missing documentation that must be rectified within 15 days to prevent your return from becoming invalid.


A notice issued under Section 139(9) of the Income Tax Act informs a taxpayer that their filed Income Tax Return (ITR) contains incomplete, inconsistent or defective particulars.

Common triggers for Section 139(9) notices include:

  • Tax Audit was mandatory (e.g. turnover exceeded statutory limits under Section 44AB), but Form 3CB/3CD was not uploaded prior to or alongside the ITR.
  • Balance Sheet and Profit & Loss numbers reported in ITR-3 or ITR-6 do not match audited financial figures.
  • Gross receipts or TDS reported in the return differ significantly from Form 26AS and AIS data.
  • Tax computation or fee/interest paid is inconsistent with total income reported.

Critical Deadline Warning

Taxpayers are allowed 15 calendar days from receipt of notice to correct the defect online. If ignored or not rectified in time, the original return is treated as invalid (never filed), exposing the taxpayer to late filing fees, loss of carried-forward losses and interest penalties.

2. Step-by-Step Procedure to Respond Online

Resolving a Section 139(9) notice must be completed on the e-filing portal (incometax.gov.in):

  1. Log into the e-filing portal using PAN/password.
  2. Navigate to Pending Actions → Response to Defective Notice u/s 139(9).
  3. Locate the relevant Notice Communication Reference Number (DIN) and click View Notice Details.
  4. Choose Agree if the defect is valid. Upload a corrected XML/JSON ITR file rectifying the error.
  5. If you disagree with the notice (e.g. tax audit was not applicable), select Disagree and input detailed remarks explaining why the return is complete and accurate.

What if You Need Extra Time?

If you cannot rectify the defect within 15 days (for instance, if your auditor requires extra time to finalize audit reports), you can submit an extension request online on the portal before the 15-day window expires. The Assessing Officer has statutory discretion to grant an extension of time upon reasonable cause.
