Amazon KDP Royalty Income in India:
Tax, Foreign Tax Credit & GST

A KDP royalty payment is a cross-border transaction in disguise: classification, foreign withholding, GST and bank reconciliation all need to be worked through before an author files.


Publishing a book on Amazon can create a global income stream. But for an Indian author, the tax question is not simply "Amazon paid me, where do I show it in my ITR?"

The real questions are: what is the income, who is paying it, where is it earned, was foreign tax withheld, is the activity a business or profession, does GST apply and how should the entire transaction be documented? This guide gives a practical framework for Indian KDP authors.

The 60-second answer

Start with the KDP arrangement, not the ITR

The most common mistake is starting with the tax return. Start with the transaction. An author may write and publish books independently, continuously operate a publishing activity, license copyright, receive payments described as royalties, incur advertising, editing and design costs and publish across several international marketplaces. The tax treatment can change depending on these facts.

The first document to review is the publishing or platform agreement. It helps answer what rights are being granted, to whom, for what consideration, whether the author is licensing intellectual property, what the payment mechanism is and which entity is involved. The word royalty appearing on a payment statement should not, by itself, settle the Indian income-tax classification.

How should KDP income be classified?

There is no one-size-fits-all answer. Depending on the facts, the income may require consideration under one of three categories.

Business income

Where the taxpayer is carrying on a systematic and commercial publishing activity.

Professional income

Only where the activity and taxpayer satisfy the applicable professional framework.

Royalty or licensing character

Where the underlying arrangement involves consideration for rights in intellectual property, or another arrangement that legally takes that character.

Classification can affect deductions, presumptive taxation, books of account, tax audit, ITR schedules, GST analysis and documentation. Classification should therefore be established before choosing the tax-computation method.

Section 44AD vs Section 44ADA: don't guess

This is one of the most common KDP tax questions. Section 44AD may be relevant where the KDP activity is an eligible business and the statutory conditions are satisfied. It should not be selected merely because the income is received from Amazon. Section 44ADA applies to specified professions subject to its statutory conditions. Being an author or writer does not automatically mean that every KDP receipt qualifies for Section 44ADA.

The correct sequence
1 Identify the nature of the activity
2 Establish the legal character of the income
3 Determine business or profession classification
4 Evaluate 44AD / 44ADA eligibility
5 Compute the tax

This is substantially safer than choosing a presumptive section first and trying to fit the facts into it.

What if you also earn salary?

This is increasingly common. Consider an author with salary of ₹18 lakh, KDP income of ₹6 lakh and foreign tax withheld of ₹60,000. The salary and KDP activity should be analysed separately: Form 16, salary income and TDS on one side, and gross platform income, classification, relevant expenses, presumptive-tax eligibility and foreign tax on the other. Country-wise foreign income, foreign tax, supporting documents, Form 67 and the relevant ITR disclosures then need to be worked out for the Foreign Tax Credit claim.

The fact that salary is the taxpayer's primary income does not change the need to correctly analyse the separate KDP activity.

Foreign tax withheld: don't ignore it

KDP payments may involve foreign withholding. Suppose gross KDP income is ₹1,00,000, foreign tax withheld is ₹10,000 and the net payment is ₹90,000. The ₹90,000 bank receipt is not necessarily the complete tax story. The tax file should establish the bridge from gross income to foreign tax to net platform payment to FX conversion to the Indian bank credit. This becomes particularly important when claiming Foreign Tax Credit.

Foreign Tax Credit and Form 67

If the same income is taxed outside India and in India, relief may be available under the applicable foreign-tax-credit provisions and tax-treaty framework. But FTC is not simply "foreign tax deducted equals full Indian tax credit." The credit needs to be computed under the applicable rules.

Where Form 67 is required for the FTC claim, it should be prepared carefully and supported by the relevant foreign-tax documentation. Foreign tax credit is a documentation exercise as much as a tax-computation exercise.

What about GST?

This is where generic internet answers often become unreliable. The answer is not "the money comes from abroad, so there is no GST." Nor is it "Amazon is foreign, so this is automatically an export of services."

First determine what the author is actually supplying. The analysis may involve licensing of intellectual property, rights granted under a publishing arrangement, supply of services, marketplace arrangements, the identity of the contractual recipient, place-of-supply provisions and export-of-services conditions. The key question is: what exactly is the legal supply under the KDP arrangement? Only after answering that question should GST registration, export treatment, LUT and related compliance be evaluated.

Don't treat every bank credit as income

A KDP author may have multiple marketplaces, multiple currencies, foreign withholding, different payment cycles, platform-level deductions and foreign-exchange conversion. A bank statement therefore provides only one part of the picture.

This reconciliation can prevent both under-reporting and duplicate reporting.

KDP tax file: keep these documents

  • KDP or publishing agreement
  • Platform tax profile
  • Royalty or payment reports
  • Foreign withholding details
  • Relevant foreign tax certificates
  • Indian bank statements
  • FIRC/e-FIRC or bank advice, where available
  • Expense records and supporting invoices

For recurring publishers, maintain the reconciliation monthly rather than reconstructing the entire year at ITR time.

Five common mistakes

"Amazon calls it royalty, so I will report it as royalty."

Not necessarily. Review the underlying arrangement.

"I received ₹90,000, so my income is ₹90,000."

Not necessarily. Check gross income and foreign withholding.

"I am a writer, so 44ADA applies."

Not automatically. Eligibility must be established.

"The payment is from abroad, so GST doesn't apply."

Too simplistic. Analyse the actual supply.

"Amazon deducted foreign tax, so I will claim the same amount as FTC."

Not automatically. FTC requires eligibility, computation and documentation.

The right way to look at KDP tax

A KDP income stream should be viewed as a cross-border transaction, not merely as an online payment. The complete picture runs from the KDP agreement to the rights and activity, to income classification, to Indian tax computation, to foreign withholding, to FTC and Form 67, to GST analysis, to FX and bank reconciliation and finally to ITR disclosure. That is the difference between simply filing a return and maintaining a defensible international-tax position.

Amazon KDP income is not difficult because the payment is complicated. It is difficult because several tax systems meet in one transaction.

If you earn from Amazon KDP alongside salary, professional income or other foreign-source income, the entire structure should be reviewed together rather than treating the KDP payment as an isolated bank credit.
